1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of Focus Better, including our website at focusbetter.io, web applications, mobile or desktop applications, APIs, and related services (collectively, the “Service”), operated by Brillarix LLC (“Brillarix,” “we,” “us,” or “our”).

By registering for an account, accessing, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility & Account Security

• Age Requirement: You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to form a binding contract. If you are between the ages of 13 and 18, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.
• Account Accuracy: You agree to provide accurate, current, and complete registration information and to maintain the accuracy of this information.
• Credential Confidentiality: You are responsible for safeguarding your login credentials. You are solely responsible for all activities that occur under your account. You agree to notify us immediately at team@brillarix.com of any unauthorized access or security breach.

3. Software License & Permitted Use

Subject to your compliance with these Terms, Brillarix grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal productivity and organization purposes.

You may not sublicense, resell, lease, or commercially exploit the Service without prior written authorization from Brillarix.

4. Acceptable Use Policy

You agree that you will NOT:

• Reverse engineer, decompile, disassemble, or attempt to derive source code from any part of the Service;
• Scrape, crawl, harvest, or extract data from the Service using automated bots, crawlers, or scripts without our express written consent;
• Attempt to probe, scan, or test the vulnerability of our systems or networks, or breach any security or authentication measures;
• Impose an unreasonable or disproportionately large load on our infrastructure (such as denial-of-service attacks or automated spamming of API endpoints);
• Upload or transmit any viruses, malware, worms, or malicious code;
• Use the Service to transmit unsolicited commercial communications, defamatory, or unlawful materials;
• Manipulate or fabricate focus sessions, streaks, or gamification parameters to defraud leaderboards or challenge systems.

5. Third-Party Integrations (Google Calendar & Gmail)

Focus Better offers optional integrations with third-party platforms, notably Google Workspace (Google Calendar and Google Mail):

• Third-Party Terms: When enabling Google integrations, you acknowledge that your use of Google services remains subject to Google's Terms of Service and Privacy Policies.
• Limited Use Guarantee: As detailed in our Privacy Policy, Brillarix strictly adheres to the Google API Services User Data Policy, including the Limited Use requirements. Your Google data is never sold, never shared with data brokers, and never used to train generalized AI/ML models.
• Revocation: You may disconnect any third-party integration at any time through your account settings.

6. User Content & Intellectual Property

Your Content: You retain full ownership of all data, text, task descriptions, and files that you input into the Service (“User Content”). By uploading User Content, you grant Brillarix a limited, worldwide, royalty-free license to store, process, display, and transmit your User Content solely to operate, improve, and provide the Service to you.

Focus Better Intellectual Property: The Service, including its code, software architecture, UI designs, brand logos, soundscapes, audio compositions, and the Mount Olympus gamification engine, is the proprietary property of Brillarix LLC and is protected by copyright, trademark, and other intellectual property laws.

7. Gamification & Virtual Elements

Focus Better incorporates productivity gamification (including “Summit Coins,” “Momentum Points,” expedition basecamps, and virtual milestone share cards):

• Virtual points, Summit Coins, and levels are informational, motivational indicators of personal productivity only.
• Virtual items have no real-world monetary value, cannot be exchanged for cash, and cannot be transferred or sold to other users.
• Brillarix reserves the right to adjust, rebalance, or update gamification algorithms, badge thresholds, and scoring formulas to improve the platform experience.

8. Pricing, Billing & Subscriptions

Focus Better provides free core features and may introduce optional paid premium subscription plans. If you enroll in a paid subscription:

• Billing: Fees will be billed on a recurring monthly or annual basis via our authorized payment processor.
• Cancellation: You may cancel your subscription at any time via your account settings. Cancellation will take effect at the conclusion of your current billing cycle.
• Refunds: Except as required by applicable consumer law, all paid fees are non-refundable.

9. Termination & Account Cancellation

You may terminate your account at any time directly through Account Settings or by emailing team@brillarix.com.

Brillarix may suspend or terminate your access to the Service immediately, without prior notice or liability, if you violate any provision of these Terms or engage in conduct that harms the platform, other users, or third parties.

12. Indemnification

You agree to defend, indemnify, and hold harmless Brillarix LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your breach of these Terms or your misuse of the Service.

13. Dispute Resolution, Arbitration & Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Binding Arbitration & Class Action Waiver: Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be settled by binding individual arbitration administered in accordance with the American Arbitration Association (AAA) commercial rules. YOU AND BRILLARIX AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
